Acceptance of Terms

By downloading, accessing, or using In The Mood (the “App”), you agree to be bound by these Terms of Use. If you do not agree to these terms, you must stop using the App immediately.

Changes to Terms

We reserve the right to update these Terms at any time. Continued use of the App constitutes acceptance of any modifications.

Use of the App

The App is provided for personal and non-commercial use. You may not copy, modify, distribute, sell, or lease any part of the App.

Subscriptions and Payments

The App offers paid subscriptions (e.g., In The Mood+) with access to additional features such as increased expiration time for mood, syncronyzation widget, and additional mood option. Payments are handled through the respective app store and are subject to their terms and conditions. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.

You can manage your subscription through your Apple App Store or Google Play Store account settings.

Refund Policy

All purchases are final and non-refundable except as required by law or as determined by the app store policies.

User Responsibilities

You agree to use the App lawfully and responsibly. You must not engage in any activity that disrupts, damages, or impairs the App.

You are responsible for ensuring that the data you input (including names, dates, relationships, or sample messages) is accurate and appropriate.

Privacy and Data

The App may collect and process limited personal data, such as names and emails. This data is handled according to our Privacy Policy. By using the app, you consent to this processing.

Intellectual Property

All rights, title, and interest in the App, including but not limited to its design, code, and branding, belong to KilkaLabs OÜ.

Disclaimer of Warranties

The App is provided “as is” without warranties of any kind. We do not guarantee that the App will be error-free or uninterrupted.

Limitation of Liability

To the fullest extent permitted by law, KilkaLabs OÜ shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the App.

Governing Law

These Terms are governed by the laws of Estonia. Any disputes arising from these Terms will be resolved in Estonian courts.

Apple App Store Terms

This End User License Agreement is entered into between you and the Developer, not Apple. The Developer is solely responsible for this app and its contents.

This license is limited to a non-transferable license to use the app on Apple-branded products that you own or control and as permitted by the App Store Terms of Service and Apple’s Usage Rules.

Apple has no obligation to provide any maintenance or support services for the app.

To the maximum extent permitted by applicable law, Apple shall have no warranty obligation whatsoever with respect to the app, and any claims, losses, liabilities, damages, costs, or expenses attributable to any failure of the app to conform to any warranty will be the Developer’s sole responsibility.

The Developer, not Apple, is responsible for addressing any claims relating to the app or your possession and/or use of the app, including, but not limited to: (i) product liability claims; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.

In the event of any third-party claim that the app or your possession and use of the app infringes that third party’s intellectual property rights, the Developer, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of such claim.

You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

Apple and its subsidiaries are third-party beneficiaries of this EULA, and upon your acceptance of the terms of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA as a third-party beneficiary.
